Earlier this year, the law changed forever. Before April 2008, it was pretty much impossible to take a large company to court charged with manslaughter.
Now that’s different and no matter what the company, if someone gets killed whilst driving at work, its going to be investigated.
If a company is found guilty, the punishment can be horrendous, with fines of up to 10% of a company’s worldwide turnover being mentioned. We understand new sentencing guidelines are to be announced early in 2009, but all the indications suggest they are going to be pretty tough.
Its also been reported in the motoring press that if a company is found guilty, they may be made to advertise its prosecution in the press or even on television….wow Just think how that will help your business
Clearly, none of us can ignore this and we must put some procedures in place to minimise our exposure.
